The Service allows businesses to track their brand mentions on Large Language Models (LLMs) such as ChatGPT, Gemini, and others, compare their brand's mention frequency for key prompts against competitors, and identify potential growth areas.
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

1. Definitions

  • "Account" means the user account you create to access and use the Service.
  • "Customer," "You," "Your" means the business or individual that creates an Account and uses the Service.
  • "Content" means any data, information, text, images, or other materials that you input or upload into the Service.
  • "LLM Data" means the aggregated and anonymised or pseudonymised data relating to brand mentions, competitor mentions, topics, trends, and sentiment extracted from Large Language Models via the Service.
  • "Service" means the SaaS analytics tool and related services provided by [Your Company Name].
  • "We," "Us," "Our," "Lunar Metrics Ltd" refers to Lunar Metrics Ltd, the provider of the Service.

2. Access to the Service

2.1 Account Creation: To access and use the Service, you must register and create an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2 Account Security: You are responsible for maintaining the confidentiality of your Account login information (username and password) and for all activities that occur under your Account. You agree to notify us immediately of any unauthorised use of your Account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.
2.3 Eligibility: You must be at least 18 years old and capable of forming a binding contract to use our Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Subscriptions and Payments

3.1 Paid Service: The Service is a paid subscription service. Details of subscription plans, features, and pricing are available on our website.
3.2 Billing: You agree to pay all applicable fees for the Service you select in accordance with the billing terms in effect at the time a fee is due and payable. All fees are quoted in British Pounds (GBP) unless otherwise stated and are exclusive of VAT or other applicable taxes, which will be added where appropriate.
3.3 Payment Information: You agree to provide valid and up-to-date payment information. We use third-party payment processors to handle all transactions. 3.5 Cancellations and Refunds: You may cancel your subscription at any time through your Account settings. Cancellations will take effect at the end of your current billing period. We do not provide refunds for any unused portion of a subscription period, except where required by law.
3.6 Price Changes: We reserve the right to change our subscription fees upon reasonable notice to you. Any price changes will take effect at the beginning of your next billing cycle.

4. Your Responsibilities

4.1 Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms, all applicable laws, regulations, and industry guidelines.
4.2 Prohibited Conduct: You agree not to:
  • Use the Service in any way that violates any applicable national, local, or international law or regulation.
  • Use the Service for any fraudulent or malicious purpose.
  • Access or attempt to access any part of the Service, Accounts, computer systems, or networks connected to the Service, or any data of other users not intended for your access, through hacking, password mining, or any other illegitimate means.
  • Interfere with or disrupt the integrity or performance of the Service or data contained therein.
  • Upload, post, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Attempt to reverse engineer, decompile, or disassemble any portion of the Service.
  • Resell, sublicense, or otherwise provide the Service to third parties without our express written consent.

5. Intellectual Property Rights

5.1 Our Intellectual Property: The Service, including all software, design, text, graphics, images, LLM Data presentation, and other content, is and will remain the exclusive property of Lunar Metrics Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Lunar Metrics Ltd.
5.2 Your Content: You retain all ownership rights in your Content. By submitting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, and display your Content solely for the purpose of providing and improving the Service to you.
5.3 LLM Data Ownership: You acknowledge that the LLM Data presented through the Service is derived from publicly available LLMs and is processed and presented by our Service. While you gain insights and analysis from this data through your subscription, Lunar Metrics Ltd does not claim ownership of the underlying LLM Data itself. We retain all intellectual property rights in the methodology, algorithms, and presentation format used to extract, process, and display the LLM Data within our Service.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Lunar Metrics Ltd disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
  • The Service will be uninterrupted, secure, or error-free.
  • The results that may be obtained from the use of the Service will be accurate or reliable.
  • The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
  • Any errors in the Service will be corrected.
The LLM Data is sourced from third-party LLMs and may contain inaccuracies, biases, or reflect incomplete information at the source. We do not guarantee the accuracy, completeness, or reliability of the LLM Data presented through the Service. You acknowledge and agree that you use the LLM Data at your own discretion and risk.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall Lunar Metrics Ltd, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Our total aggregate liability to you for any and all claims arising out of or in connection with these Terms or your use of the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the event giving rise to the liability.

You agree to defend, indemnify, and hold harmless Lunar Metrics Ltd and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees), resulting from or arising out of:
  • Your use and access of the Service, by you or any person using your Account.
  • A breach of these Terms.
  • Your Content.
  • Your violation of any rights of a third party, including without limitation any intellectual property right, privacy right, or data protection right.

9. Termination

We may terminate or suspend your Account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your Account, you may simply discontinue using the Service or follow the cancellation procedure in your Account settings.
Upon termination, your right to use the Service will immediately cease. Sections 5, 6, 7, 8, 9, 10, and 11 will survive any termination of these Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
You agree to submit to the exclusive jurisdiction of the courts located in England and Wales to resolve any dispute arising out of or relating to these Terms or the Service.

11. General Provisions

11.1 Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Lunar Metrics Ltd regarding our Service and supersede and replace any prior agreements, oral or otherwise, regarding the Service.
11.2 Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11.3 Waiver: No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Lunar Metrics Ltd to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
11.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
11.5 Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.
